Terms of Use
Effective 25 September 2026 · Version 2026-09-25
EvalGain helps parents and students practice for exams with AI-based evaluation of handwritten answer sheets. These Terms explain the rules for using it, including the limits of AI evaluation.
1. About these terms
These Terms of Use ("Terms") form an agreement between you and [Company legal name] ("EvalGain", "we", "us") for the use of the EvalGain website, apps and services (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who can use EvalGain
Accounts are created and held by a parent or legal guardian who is at least 18 years old, for the use of their child. The child is a minor, and may use the Service only under the supervision of the parent or guardian who holds the account.
- You must give accurate information when you sign up and keep your login details confidential.
- You are responsible for everything done through your account, including use by your child.
- One account is for one child. Tell us promptly at contact@evalgain.com if you think your account has been misused.
3. What the Service does
EvalGain is an AI-based evaluation platform. You upload photos or scans of your child's handwritten answer sheets, and the Service uses automated systems, including third-party large language models and optical character recognition, to read the answers, compare them with model solutions and marking schemes, and produce scores, mistake analysis, reports and practice suggestions.
We may change, add or remove features over time. We aim to keep the Service available but do not promise that it will be uninterrupted or error-free.
4. AI evaluation: important limitations
Please read this section carefully. By using the Service you acknowledge that:
- Results are generated by AI and may be wrong. Handwriting may be misread, answers may be marked incorrectly, and steps, diagrams or alternative valid methods may be missed or misjudged.
- Scores are indicative only. They are an estimate intended to support practice and learning. They are not an official evaluation and are not a substitute for assessment by a qualified teacher.
- No guarantee of board exam performance. A score, grade, rank or prediction shown by EvalGain does not guarantee, and is not a reliable indicator of, the marks or result your child will achieve in any school, board (including CBSE) or competitive examination. Actual examinations are evaluated by the examining body under its own marking schemes and practices.
- Not affiliated with any board. EvalGain is independent and is not endorsed by or affiliated with CBSE or any other examination board. Board names and past papers are referred to only to describe the content we support.
- You should review results with your child, use your own judgement, and not rely on the Service as the sole basis for important academic decisions.
If you believe a result is wrong, you can report it from the relevant answer sheet or contact us, and we will review it. Re-evaluation may be limited as described in the product.
5. Your uploads
You keep ownership of the answer sheets and other material you upload ("Your Content"). You give us a non-exclusive, royalty-free licence to store, copy and process Your Content, including by sending it to our service providers described in the Privacy Policy, only as needed to provide, secure and improve the Service for you.
When you upload content you confirm that:
- it is your child's own work, or you otherwise have the right to upload it;
- it does not include other people's personal information (for example another student's name or roll number) beyond what is unavoidable on the page;
- it is not unlawful, offensive, or unrelated to studying.
We may remove content, or suspend processing of it, if it breaks these Terms.
6. Acceptable use
You must not:
- use the Service to cheat in, or gain an unfair advantage during, any live examination or assessment;
- copy, resell or publicly distribute the Service, its reports, model solutions or question content;
- attempt to access other users' data, probe or disrupt our systems, or bypass limits on credits or usage;
- use automated tools to access the Service except through features we provide;
- upload malware or material that infringes anyone's rights.
7. Free trial, plans, credits and payments
- New accounts may receive free evaluation pages for a limited trial period, as shown at sign-up. Unused trial pages expire at the end of the trial.
- Paid plans and top-up credits are priced as shown in the product at the time of purchase, inclusive or exclusive of taxes as stated there. Evaluation usage is measured in pages or credits as described in the product.
- Plans are tied to the academic cycle and expire on the date shown in the product (currently 31 July at the end of the academic year) unless stated otherwise.
- Payments are processed by our payment partner, Razorpay. We do not receive or store your full card or bank details.
- Refunds, if any, are handled as described at the point of purchase. For billing questions or refund requests, write to contact@evalgain.com.
8. Our intellectual property
The Service, including its software, design, reports, model solutions, explanations and branding, is owned by us or our licensors. We grant you a limited, personal, non-transferable right to use the Service for your child's own studies while your account is active. Question papers and syllabus material remain the property of their respective owners.
9. Suspension and closing your account
You can stop using the Service at any time and ask us to close your account and delete your data, as explained in the Privacy Policy. Withdrawing your consent to data processing also closes the account, because the Service cannot work without it.
We may suspend or close an account that breaks these Terms or the law, or to protect other users or the Service. Where reasonable we will tell you first.
10. Disclaimers and limitation of liability
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including accuracy of evaluations, fitness for a particular purpose and non-infringement.
To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for any loss arising from reliance on AI-generated scores, feedback or predictions, including exam results, admissions or academic decisions. Our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.
Nothing in these Terms limits any liability that cannot be limited under applicable law.
11. Indemnity
You agree to indemnify us against claims, losses and costs arising from Your Content or from your breach of these Terms or of the law.
12. Changes to these terms
We may update these Terms. We will show the new effective date on this page and, for material changes, notify you by email or in the product before they apply. If you continue to use the Service after the changes apply, the updated Terms will govern your use.
